ISSUE

Second Amendment

BILL NAME
H.3418
Read the bill text

ABOUT THIS BILL
This bill is an amendment to the Code of Laws Section 16-23-500. It prohibits the possession of guns and ammunition by anyone convicted of a "violent crime,” punishable by up to five years in prison and confiscation of any firearms and ammunition involved. However, the amended bill now includes persons convicted of a crime punishable by imprisonment of more than one year, and provides increased, graduated penalties for repeated violations of up to 30 years imprisonment.

WHY THIS BILL IS WRONG
This bill greatly expands ways to take away your guns and ammunition, a blatant violation of your Second Amendment rights. Our representatives should support our Second Amendment rights, not take them away. The new version of the bill takes out "convicted of a violent crime" but adds "convicted of crimes punishable by imprisonment of more than one year." This includes many Class B Misdemeanor non-violent crimes such as:
  • Trespassing on state park property, SC Code of Laws 51‑3‑150
  • Recording a movie in a theater on a cell phone, SC Code of Laws 16‑11‑920(A)(2)
  • Use of a slug or false coin to operate a vending machine, SC Code of Laws 12‑21‑2714
See the South Carolina Code of Laws

CALL-TO-ACTION
Reject this bill because it is too wide and takes away gun rights for non-violent crimes that have nothing to do with guns and ammunition. Call, email, or write to Representatives Bryant, Pope, and Wooten, and tell them you don’t want this bill to pass.
